Our Shakopee Minnesota Family Law Services

Martine Law helps Shakopee families with divorce, child custody, parenting time and property division. Before deciding your next step, identify any existing court order, upcoming hearing or deadline in your case.

Where is the court for Scott County family cases?

The Scott County District Court handles family cases filed in Scott County. The Scott County Justice Center is at 200 Fourth Avenue West, Shakopee, MN 55379. Court administration can be reached at (952) 496-8200. Follow your hearing notice for the location or remote-access instructions; do not assume every hearing requires a courthouse visit.

What should I prepare for a family law consultation?

Gather your current orders, papers you have received, case number and hearing dates or response deadlines. For custody or parenting-time questions, outline the current schedule and the changes you want to discuss. For divorce and property questions, prepare a list of assets, debts and available financial records. Tell the intake team about urgent deadlines or safety concerns so an attorney can evaluate the legal issues.

If your hearing is in person, the court’s Scott County courthouse visitor guidance recommends allowing time for parking, security screening and finding your courtroom. Check the court’s instructions before your visit.

Family Law Frequently Asked Questions

Our family law attorneys handle a wide range of cases involving family-related issues. These include divorce, child custody and visitation, property division, and more.

A family law attorney can assist with divorce proceedings by providing legal advice, representing you in court, and helping you navigate the complexities of the divorce process. They can help with filing necessary documents, negotiating settlements, and ensuring that your rights and interests are protected throughout the process.

When seeking child custody arrangements, it’s important to consider the best interests of the child. This includes factors like the child’s physical and emotional needs, the stability of each parent’s home environment, and the ability of each parent to provide care. A family law attorney can help you understand the legal standards and work towards an arrangement that supports your child’s well-being.

The standard depends on what you want to change. A change in income or plans to relocate does not automatically justify changing custody. Under Minnesota Statutes 518.18, custody changes generally require changed circumstances, the child’s best interests and an additional statutory ground, such as the parents’ agreement or endangerment with the required balancing of harm and benefit. Filing time limits and exceptions also apply.

Changes to parenting time that do not change the child’s primary residence generally use a best-interests standard under section 518.175, subdivision 5; restrictions require additional findings. Bring your current order and the facts supporting your request to an attorney, who can identify the applicable standard. Read more about Minnesota custody modifications.
